1. Purpose and scope

These Terms and Conditions of Sale (the “Terms”) govern every order placed by a buyer (hereinafter « the Customer ») on the Helvitic platform. By confirming an order, the Customer fully and unreservedly accepts these Terms.

Helvitic is a marketplace connecting independent Swiss winemakers with buyers. Each winemaker is the sole seller of the wines it offers; Helvitic acts as an intermediary and service provider.

2. Products and prices

The wines offered on Helvitic are exclusively Swiss wines holding a Controlled Designation of Origin (AOC), produced and sold directly by the listed winemakers.

Wine prices are set freely by each winemaker and correspond to their standard cellar-door price: a wine sold at a given price at the cellar is offered at the same price on Helvitic. Helvitic neither sets nor alters wine prices.

All prices are shown in Swiss francs (CHF), inclusive of all taxes at the applicable VAT rate (8.1%). The price applicable to an order is the one displayed at the time it is confirmed. Each winemaker reserves the right to change their prices at any time, without effect on orders already confirmed.

The minimum price per bottle is CHF 12.00. Only the standard bottle sizes (50 cl, 70 cl, 75 cl) are offered for sale.

3. Ordering

Every order is subject to a minimum of 6 bottles per cellar, according to the valid formats: any multiple of 6 bottles (6, 12, 18, 24…), up to 72 bottles per cellar. Mixing different wines from the same cellar is accepted. An order placed with several cellars generates separate deliveries.

The order is final once payment is confirmed. A confirmation email is sent to the Customer at the address provided during payment.

4. Payment

Payment is secured and processed exclusively via Stripe Checkout (PCI-DSS certified). The accepted payment methods are: bank card (Visa, Mastercard) and Twint.

Payment is due in full at the time the order is confirmed. No banking data is stored by Helvitic; this data is processed directly by Stripe.

5. Delivery

Delivery is provided only within Switzerland by our specialised carrier VinoLog (Swiss Post). The estimated delivery time is 3 to 5 working days after dispatch by the winemaker. An order of more than 12 bottles may be shipped in several parcels.

When ordering from several cellars, shipping costs apply independently for each cellar.

Default coverage & signature (complimentary)

Every parcel is covered by default by Swiss Post up to CHF 500 of value, free of charge for the Customer. As long as a parcel stays below this threshold, the Customer may opt free of charge for signature-on-delivery, covered by Helvitic. In the absence of this option, the Customer expressly accepts full responsibility in the event of theft, loss or damage occurring after the parcel is dropped off by the carrier. Helvitic accepts no liability beyond the carrier’s default coverage if the signature option was not selected.

Transport insurance (complimentary)

Above CHF 500 of value per parcel, signature-on-delivery is applied automatically; above CHF 1500, complementary transport insurance is added automatically, free of charge for the Customer, covered by Helvitic. It covers the actual value of the goods up to CHF 5000 per parcel according to the applicable general terms of Swiss Post. The basis for reimbursement is the cost price of the goods, excluding VAT.

6. Right of withdrawal

In accordance with Swiss law, perishable foodstuffs — including wine — are excluded from the right of withdrawal provided for under consumer law. Once an order is confirmed, it cannot be cancelled.

However, in the event of a product damaged in transit or not matching the order, the Customer has 48 hours after receipt to report the issue to contact@helvitic.ch, with supporting photos. A replacement or refund will be considered on a case-by-case basis.

Damaged parcel — required step. Where the damage occurred in transit, the Customer keeps the original packaging and its contents and has the damage recorded at a post office within 8 days of receipt. Swiss Post requires this report for any compensation: without it, the transport cover is lost and replacement cannot be guaranteed. Reporting to Helvitic within 48 hours is still required alongside it.

7. Warranties and claims

The wines benefit from the statutory warranty against defects under the Swiss Code of Obligations (art. 197 et seq. and 210 CO): the selling winemaker is liable for defects that deprive the wine of an expected quality — cork taint, oxidation, or non-conformity with the stated vintage, grape variety or AOC. This warranty runs for two years from delivery and cannot be reduced.

A visible defect (breakage in transit, wrong item) must be reported within 48 hours of receipt; breakage in transit must additionally be recorded at a post office within 8 days (see art. 6). A hidden defect — such as cork taint, detectable only upon opening — must be reported as soon as it is discovered to contact@helvitic.ch, with a photo and description. The Customer keeps the bottle and the remaining wine for 14 days.

After verification, Helvitic arranges as a priority the replacement of the affected bottle(s) by the selling winemaker; if the wine is no longer available, they are refunded. Returning the defective bottle is not required as a rule; where it is exceptionally requested, the return shipping is borne by the winemaker. No shipping or other cost is charged to the Customer in respect of a defect.

Helvitic acts as an intermediary; the statutory warranty and ultimate responsibility for product quality lie with the selling winemaker. Helvitic coordinates and facilitates resolution between the Customer and the winemaker concerned.

8. Age verification (18+)

In accordance with Swiss federal law, the sale of alcohol is strictly prohibited to persons under 18. By placing an order, the Customer certifies that they are of legal age. Helvitic reserves the right to cancel any order in case of doubt about the Customer’s age.

The carrier may verify the recipient’s identity upon delivery. If no adult is present at delivery, the parcel will be returned to the winemaker.

9. Liability

Helvitic cannot be held liable for indirect damages, loss of business or harm of any kind resulting from the use of the Platform. Helvitic’s liability is limited to the amount of the order concerned.

Helvitic does not guarantee the permanent availability of the Platform and reserves the right to interrupt access for maintenance.

10. Applicable law and jurisdiction

These Terms are governed by Swiss law, in particular the Code of Obligations (CO) and the Federal Act on Data Protection (FADP). In the event of a dispute, the parties undertake to seek an amicable solution. Failing that, the exclusive jurisdiction is that of Helvitic’s registered office, in Switzerland.
